Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the http://kearnsgardenrooms.co.uk website (the “Service”) operated by Kearns Garden Rooms (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Deposit

  • When placing an order, a 25% deposit is required upfront (paid via bank transfer) to secure your booking.
  • The deposit is non-refundable unless cancelled within 48 hours of the deposit being paid (unless otherwise agreed in writing)
  • The remaining balance is to be paid on the day that the installation is completed by either bank transfer or cash and must be paid before the team leave the property.
  • If the customer fails to pay the remaining balance, we reserve the right to repossess any of the goods/materials supplied.

Guarantee

  • Our summer houses come with a 12-month warranty, however, please be aware that timber is a natural living material and is subject to movement, swelling, and warping caused by temperature and moisture changes. These are not fault’s and are not covered by the guarantee.
  • We use pressure treated timber for our builds, but as timber is a natural product, it can absorb water. We recommend that you use a waterproof treatment once our installation is complete, and we recommend this is repeated annually to ensure the longevity of the building. Failure to initially treat the building once installed will void the warranty.
  • Once the building has been installed, the customer will check the building before making the final balance payment. Once the customer has confirmed they are satisfied with the installation, they cannot reject the goods.
  • Any wilful damage, damage caused due to neglect, misuse of the building or alteration of the building by the customer will void the warranty.
  • We do not supply guttering with our buildings, unless requested by the customer at the time of ordering, which will be charged accordingly. We recommend fitting guttering once the installation is completed to ensure water is directed away from the rear of the building. Any leaks/damp patches caused because of not fitting guttering will not be covered by the guarantee.
  • The EPDM rubber roof is supplied and fitted in one solid piece to prevent leaks. Any rips or tears that occur after installation caused by improper care or acts of god will not be covered by the guarantee.  

Installation

  • There must be suitable road access with no parking restrictions, red or yellow lines to allow us to remain parked, without time limit, whilst we install.
  • It is the customers responsibility to ensure that the base is flat, level, and solid, prior to installation. Any movement in the building after installation that occurs from an insufficient base may void the guarantee.
  • The customer must provide photos of the base and access to the base area at least one week before the agreed installation date, to ensure it is sufficient. Any failure to do so may result in the installation date being altered/delayed.
  • The customer must inform the company of any obstructions, prior to ordering to ensure it is possible to carry materials to the build site.
  • If we arrive at the property and are unable to install due to an insufficient base or access requirements, your installation will be moved to the next available date, and you may incur a further charge for any inconvenience.
  • The company are not liable for any issues with late delivery of goods whatsoever. 
  • We are always extremely careful when on a customer’s property, however if we have to carry sections/materials through buildings, over fences etc, then we cannot accept any responsibility for accidental damage that may occur to these items.
  • We accept no responsibility for any damage resulting from existing structural or other defects at the property. 
  • We will not accept any responsibility for the deterioration of the building caused by a poor or unlevel base, failure to fit guttering or failure to apply waterproof treatment.

Cancellation/Alteration of Order

  • Should the customer wish to alter the specification that was agreed on at the time of ordering, the customer must inform us immediately.
  • Any alterations to the specification of the building may result in increased cost to the customer.
  • We reserve the right to change any agreed specifications of goods to ensure the structural integrity of the building and agree to inform the customer of any alterations.

Customer Responsibilities

  • If any consents, licences or other permissions are required from any third parties such as landlords, local authorities or similar, you must obtain these before we attend to install.
  • In the event we are required to access neighbouring land to access the build site, this must be organised in advance. We are not liable for any delays that may arise due to inability to gain access.
  • It is the customers responsibility to treat the building with a waterproof treatment once our installation is complete, and we recommend this is repeated annually to ensure the longevity of the building. 
  • It is the customers responsibility to ensure that guttering is fitted to the building once installation is completed. Any damage caused, because of this not being done, will not be covered by the guarantee.
  • It is the customers responsibility to ensure that the correct size building is ordered. As these buildings are made to order/bespoke, if when we arrive the building ordered will not fit in the area designated, full payment will still be required to cover the cost of the materials used, time spent building the room and lost time for delivery/installation as finding another buyer may not be possible. 

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Kearns Garden Rooms and its licensors.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Kearns Garden Rooms.

Kearns Garden Rooms has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Kearns Garden Rooms shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 60 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
